Agreement to Terms
By accessing or using the services provided by iDesign ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Our Services
iDesign provides digital design and software development services, including but not limited to design systems, web applications, digital products, brand and strategy, performance optimization, and launch support. The specific scope, deliverables, and timelines for each project are defined in individual project agreements.
Intellectual Property
Upon full payment, clients receive ownership of the final deliverables as specified in the project agreement. iDesign retains the right to showcase completed work in our portfolio unless otherwise agreed in writing. All pre-existing tools, frameworks, and methodologies used by iDesign remain our intellectual property.
Client Responsibilities
Clients agree to: • Provide accurate and timely information, content, and feedback necessary for project completion. • Review and approve deliverables within the agreed timelines. • Ensure they have the rights to any content, images, or materials provided to us for use in the project. • Designate a primary point of contact for project communication.
Payment Terms
Payment terms are outlined in individual project agreements. Unless otherwise specified, invoices are due within 15 days of issuance. Late payments may result in project delays or suspension of services. All fees are non-refundable once work has commenced, unless otherwise stated in the project agreement.
Limitation of Liability
To the maximum extent permitted by law, iDesign shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services. Our total liability for any claim shall not exceed the total amount paid by the client for the specific project in question.
Termination
Either party may terminate a project agreement with written notice as specified in the project agreement. Upon termination, the client is responsible for payment of all work completed up to the termination date. iDesign will deliver all completed work upon receipt of final payment.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of El Salvador. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if necessary, through the competent courts of El Salvador.
